The Barnstable Probate and Family Court is at 3195 Main Street in Barnstable, P.O. Box 346. Register Anastasia Welsh Perrino, Esq. oversees operations here. This court handles civil matters that involve family law and estates: divorce, guardianship, conservatorship, adoption, wills, and related filings. The standard hours are Monday through Friday from 8:30 AM to 4:30 PM, and you can reach the court at (508) 375-6710.
The Barnstable Probate and Family Court was one of the first courts in Massachusetts to offer a Virtual Registry service. This remote access option runs Monday through Friday from 9:00 AM to 12:00 PM and again from 2:15 PM to 4:00 PM. Residents who need help with filings, forms, or questions about civil cases in the probate system can connect via Zoom at the court's listed meeting link rather than driving to Barnstable. This is a real advantage for people who live in Falmouth, Orleans, or the outer Cape towns that are a long drive from the courthouse. The court also holds Wednesday Magistrate Walk-In Sessions from 8:30 to 11:00 AM by appointment.
Copy fees for Barnstable Probate records follow the statewide schedule. Attested copies run $2.50 per page, while unattested copies cost $0.05 per page. Barnstable County District Court Civil Records
Barnstable County has three District Courts that handle civil cases, including small claims matters and civil actions under the District Court civil jurisdiction limit. Each court serves a defined set of Cape Cod towns, so where you file depends on where the parties are located. Civil records at each District Court are specific to that court and not shared across locations. The MassCourts online system at masscourts.org is the best way to confirm which court holds a specific civil case before you make a trip.
The Barnstable District Court at 3195 Main Street, P.O. Box 427, Barnstable handles civil filings for the towns of Barnstable, Yarmouth, and Sandwich. Clerk-Magistrate Charles J. Ardito oversees this court, which shares the Main Street complex with the Superior Court and Probate Court. Reach the Barnstable District Court at (508) 375-6778. For those in the mid-Cape area, this is likely the District Court for your civil case. The Falmouth District Court at 161 Jones Road, Falmouth serves Falmouth, Mashpee, and Bourne. Clerk-Magistrate Edward B. Teague runs this court, which also operates an Adult Drug Court. Call (508) 495-1500 for Falmouth District Court inquiries.
The Barnstable District Court page on mass.gov has the current contact details and a list of the towns this court serves for civil filings in the mid-Cape area.
The Orleans District Court at 237 Rock Harbor Road, Orleans covers a wide stretch of outer Cape towns: Brewster, Chatham, Dennis, Eastham, Orleans, Harwich, Truro, Wellfleet, and Provincetown. If you have a civil case involving a party in any of these communities, civil court records will be at the Orleans court. Reach Orleans at (508) 255-4700. The driving distance from Provincetown to Orleans is much shorter than the drive to Barnstable, which is why this third court exists to serve the outer Cape communities.
See the Falmouth District Court page on mass.gov for address, phone number, and the list of towns served for civil case filings in the western Cape area.
Note: Orleans District Court serves nine towns across the outer Cape, covering more communities than either of the other two Barnstable County District Courts.
Search Barnstable Civil Court Records Online
The Massachusetts Trial Court's free public search tool is at masscourts.org. Go to the site and select "Barnstable County" to search civil court records from the Superior Court, all three District Courts, and the Probate and Family Court. You can search by party name, docket number, or case type. Results show the names of both parties, the filing date, docket entries, and the current case status. You do not need an account to search. The system is free and open to the public at any time.
The online docket shows the key facts for most civil cases: who filed, when they filed, what motions were made, and what orders came out of the case. Full documents are not always available through the online system. If you need the actual complaint, a motion, or a signed judgment, you will need to contact the clerk at the courthouse where the case was filed. Records from 2009 forward are generally available online. For older Barnstable County civil court records, you may need to contact the archives or visit the court in person to check whether the file is stored on site or off site.
The Barnstable Probate and Family Court also has a dedicated Virtual Registry through Zoom for residents who need help with probate-related civil records. That service is available on weekday mornings and early afternoons. Check the court's mass.gov page for the current Zoom link and session times. For the most current information on virtual access, the Barnstable Probate Virtual Registry page on mass.gov has the full details.
Note: Online records at masscourts.org generally cover cases filed from 2009 forward; older Barnstable County civil court records may require an in-person or written request.
Barnstable County Law Library
The Barnstable Law Library is at 3195 Main Street, P.O. Box 398, Barnstable. You can reach the library at (508) 362-8539. The law library sits within the same court complex as the Superior Court, Probate Court, and Barnstable District Court, making it easy to combine a research visit with a trip to the clerk's office. Massachusetts law libraries serve the public, not just lawyers. If you are looking up how to file a civil case, how to respond to a complaint, or how to read a court docket, the staff can point you to the right materials.
The law library has access to case law, civil procedure rules, and local court forms. If you are handling a civil matter without an attorney, this is a good first stop before you go to the clerk's window. Research assistance is available during regular library hours. The staff cannot give legal advice, but they can help you find the right source for the procedural information you need.
